Court Sides with Mariah Carey in Dispute over Christmas Song

After hearing two experts for each side, Ramírez Almadani agreed with those of the Defense, who said that the writers employed current Christmas shots that existed before the two songs, and that Carey’s song used them differently. She said that the complainants had not welcomed the burden to show that the songs are significantly similar.

Ramírez Almadani also ordered sanctions against the complainants and their lawyers, claiming that their trial and subsequent deposits were frivolous and that the lawyers of the complainants “made no reasonable effort to ensure that the affirmed factual affirmations have proof support”.

She said they had to pay at least part of the defendants’ lawyer fees.

Defense lawyers and Carey publicists did not immediately respond to a request for comments.
