How to Remove a New York Mayor—and What Comes Next

FOr for a moment, it seemed that the mayor of New York Eric Adams could leave without Scot. But as the pressure is feared that his ability to govern is compromised, Governor Kathy Hochul said on Monday that she was going to weigh if she should withdraw the Democratic Mayor from his office in what would be an unprecedented action in the ‘History of New York State.
On February 10, the Ministry of Justice ordered federal prosecutors to suppress accusations of corruption against Adams on the grounds that the case “unduly restricted” to Adams’ ability to execute President Donald Trump’s agenda to suppress illegal immigration. The news was followed by a series of resignations from the senior officials of the Ministry of Justice as well as the four deputy mayors of the city.
Now, more and more democratic politicians are joining the calls for the resignation of Adams – or Hochul to remove it if he does not. Here’s what you need to know how it would work – and what could come.
How could Adams be withdrawn from his duties?
The Governor of New York is empowered to withdraw the mayor of New York from his functions by the law of the state and the charter of the city. In accordance with the city’s charter, Hochul can withdraw Adams from office after providing him with a “copy of the accusations and an opportunity to be heard for his defense”.
In this case, Adams would be suspended in his post up to 30 days, during which Adams would need to present his defense. Once Adams had the opportunity to assert himself, the governor could either restore him to his office, or to permanently withdraw as mayor.
What these procedures might look like is not entirely clear, mainly because it has never happened before. Adams is the first mayor in New York to face criminal accusations during his duties, and if Hochul fulfills him with his functions, he would be the first to be removed from his functions. Two former mayors – Jimmy Walker in 1932 and William O’Dwyer in 1950 – were repressed.
After the accusation of Adams in September, Hochul and his office would have started to examine his power to withdraw the mayor, before expressing his support in October. But on February 17, she pointed out that her calculation had perhaps changed.
