Jury deadlocks in Tornado Cash trial, judge issues Allen charge

After four days of deliberations, the jurors of the trial on the storm of the novel declared in court that they remained in an impasse on certain accusations, which aroused the use of an Allen accusation to encourage a more in -depth discussion.

An Allen accusation, sometimes called “accusation of dynamite”, is a special investigation that a judge gives a jury in the dead end, exhorting them to re -examine their positions and to try to reach a unanimous verdict.

According to judicial reports on Wednesday by Inner City Press, Storm lawyer Brian Klein opposed the charge, arguing that the jury had clearly indicated that a unanimous verdict was unlikely and rather urged the court to consider accepting a partial verdict.

Judge Katherine Polk Failla was attached to the prosecutors, who preferred to put pressure on continuous deliberations rather than accepting a partial verdict, with the assistant American prosecutor Thane Arad saying: “Cross this bridge when we get there.”

This decision maintains the life trial and delays a potential trial, but also highlights the deep divisions of the jury on the key aspects of the government’s case.

Defense claims that Storm wrote the Open Source code and had no control over how it was used, which raises wider questions about the responsibility of software developers in decentralized systems.

The case has important implications for Crypto developers and liability limits for writing decentralized software. If he is convicted of all the counts and taking into account the maximum sanctions, Storm could incur up to 45 years in prison.
